is a sample of our Training Contract

(hereinafter the ‘Client’)
Welcome to vom Haus Gochi German Shepherds, a professional
dog training service. This document is
between Client and Fred N. Gochuico, (hereinafter, the ‘Trainer’) and
constitutes a contract for certain services (hereinafter, the
‘Agreement’). Please read it carefully
and raise all questions and concerns that you have before you sign it.
Services:
=======
The service provided by the Trainer is dog obedience
training for specific skills. Goals and
priorities for training will be decided jointly between the Client and Trainer.
The purpose of Trainer is to teach Client to train Client’s dog. Training will address a variety of goals
including training specific new skills such as: heel, sit, stay, down, and
come.
Feedback:
=======
If, at any time, Client is not satisfied with the
procedures, goals, or other elements of the training program, then Client must
notify Trainer immediately. Client and Trainer will then mutually agree to
adjust Client’s training program as needed.
Client and Trainer will continue to work on the goals that Client
defines. If Client desires to end training sessions, the Trainer will cease all
activities in a timely fashion.
Session Time:
==========
Four training sessions, each 30 minutes or an one-hour in
length are scheduled at the mutual convenience of the Trainer and the
Client. The day and time for the next
session will be scheduled at the close of each session. If problems outside the
control of either Client or Trainer prohibit a scheduled session, then Trainer
and Client will agree to another mutually convenient time. Select Training Program:

Please note that a travel fee
of $.50 per mile round trip will be added for locations 10 miles outside our
service area of zip code 92647. We’ll
calculate your travel fee when you call our office to schedule your private
in-home dog training.
Payment Procedure:
===============
Full payment is due prior to start of the first training
session. If services are not paid in
full prior to a scheduled first session, then the next session will not
proceed. Any changes to the session’s
payment procedure shall be mutually agreed to between Client and Trainer, in
writing, prior to the change taking effect.
Cancellations:
==========
Client must give 48 hours prior written notice, to Trainer’s
email address, to cancel or change the time of an appointment. If 48 hours
notice is not given pursuant to this clause then Client will be charged, in
full, for the session. However, if a technical issue or emergency prevents
Client from participating in the session, Trainer shall use his best endeavors
to reschedule Client’s session as soon as possible.
Termination:
=========
Either
party may end the training relationship by providing the other party with a
one-week notice. Notwithstanding the
aforementioned, Trainer may terminate this Agreement at any time if Trainer has
any doubt as to the temperament or suitability of Client’s dog to the services
provided by vom Haus Gochi German Shepherds.
Confidentiality:
===========
Trainer and Client mutually recognize that they may discuss
training plans and methods, goals, personal information, and other private
information. Trainer will not
voluntarily communicate the Client's information to a third party. Client shall not disclose, or cause to be
disclosed, any information regarding Trainer or vom Haus Gochi German Shepherds
training techniques, materials, methods, trade secrets, know-how or any other
information not already disclosed to the public by Trainer.
Dispute Resolution
==============
Any controversy, claim, cause of action or similar arising out of or relating to the Agreement,
or the breach of the Agreement, shall be settled by arbitration, which will
occur via telephone by an arbitrator that we mutually agree upon. The costs of the arbitration shall be borne
by the losing party.
Disclaimer
==============
Client understands and accepts that Trainer is not a
substitute for veterinary, animal behavior or legal advice and Trainer is not a
veterinarian or animal behaviorist. Client further agrees to indemnify and hold
harmless Trainer for any injuries or damages caused by the direct or indirect
use of Trainer’s services.
Choice of Law
===========
The terms of this Agreement shall be construed in accordance
with the Laws of the State of California.
Full Agreement
==============
Client’s signature below indicates that Client has read the
information in the Agreement and the Schedules and on Trainer’s website, and
agrees to abide by its terms and conditions during our professional training
relationship.
